Return to Duty Process related to drug and/or alcohol testing following violation of 49 CFR 382, Subpart B.
After a driver violates federal drug and alcohol regulations under 49 CFR 382, Subpart B, they must complete specific testing requirements before returning to safety-sensitive duties. Our service focuses on the critical final steps — Return-to-Duty testing and Follow-Up testing management — ensuring your drivers meet FMCSA requirements quickly and correctly.
Our Return-to-Duty Testing Services Include:
- Return-to-Duty Testing: Once the driver has completed any required evaluation and treatment independently, we coordinate and administer the mandatory return-to-duty drug and/or alcohol test.
- Clearinghouse Reporting Compliance: As part of the Return-to-Duty process, employers must record specific testing events in the FMCSA Drug and Alcohol Clearinghouse. We assist in ensuring your driver’s return-to-duty test results are properly reported and that your Clearinghouse records remain fully compliant.
- Follow-Up Testing Program Management*: After passing the return-to-duty test, the driver must undergo a series of follow-up tests as determined by a qualified Substance Abuse Professional (SAP).
We help by:
- Setting up a documented follow-up testing schedule based on SAP instructions.
- Coordinating unannounced follow-up drug and/or alcohol tests for at least 12 months or longer, depending on SAP requirements.
- Ensuring full FMCSA compliance to protect your company from fines or authority issues.
* This portion may not be purchased online as it is dependent on the program outlined by your SAP.
